DMCA Policy

Purobeach Resort Santa Ponsa (hereinafter "Purobeach") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), Purobeach will respond expeditiously to claims of copyright infringement committed using the Purobeach website, applications, or services (collectively, "Services") if such claims are reported to Purobeach's Designated Copyright Agent identified below.

This policy describes the information that should be present in a DMCA notice, as well as the information required for a valid counter-notification. It also outlines the steps Purobeach will take upon receiving a valid notice or counter-notification.

Filing a Notice of Copyright Infringement (DMCA Notice)

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Purobeach Services by completing the following DMCA Notice of Alleged Infringement and delivering it to Purobeach's Designated Copyright Agent.

Upon receipt of a valid DMCA Notice, Purobeach will remove or disable access to the infringing material and take reasonable steps to notify the user who posted the material that Purobeach has removed or disabled access to it.

  1. Identification of the copyrighted work: Provide sufficient detail to identify the copyrighted work that you claim has been infringed. This includes the title of the work, and if applicable, the author, copyright registration number, and URL where it can be found.
  2. Identification of the infringing material: Identify the material that you claim is infringing and needs to be removed or access disabled. Provide sufficient information (e.g., URL of the specific page on the Purobeach Services where the material is located) to allow Purobeach to locate the material.
  3. Your contact information: Include your full legal name, mailing address, telephone number, and email address.
  4. A statement of good faith belief: Include a statement that you have a good faith belief that use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., "I have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.").
  5. A statement under penalty of perjury: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner (e.g., "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.").
  6. Your electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with Purobeach's Designated Copyright Agent. Upon receipt of a valid counter-notification, Purobeach may restore the removed material or cease disabling access to it within 10-14 business days, unless the copyright owner files an action seeking a court order to restrain the user from engaging in infringing activity related to the material on Purobeach's Services.

  • Identification of the material: Identify the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled (e.g., URL).
  • A statement of good faith belief: Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled (e.g., "I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.").
  • Your contact information: Include your full legal name, mailing address, telephone number, and email address.
  • Consent to jurisdiction: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Purobeach may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person (e.g., "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, for any judicial district in which Purobeach may be found, and I will accept service of process from the person who provided the original notification of infringement or an agent of such person.").
  • Your electronic or physical signature: A physical or electronic signature.
